The system treats a treaty as binding exactly until honoring it becomes expensive, and then treats the expense as the reason it can't be done. Why it stays broken: resource-extraction industries hold a direct financial interest in land and water rights remaining unresolved, since unresolved status preserves access that full recognition of sovereignty would restrict, and the legal and political cost of full compliance falls on institutions — governments, agencies — that bear none of the extraction revenue and have correspondingly little incentive to absorb the cost of settling it. The inefficiency amplifies itself: each year of delay adds new extraction, new development, and new economic activity built on the unresolved status, which raises the political cost of resolution the longer it's deferred, rather than lowering it. The types that profit from the broken state: extraction and resource-development operators holding rights contingent on land and water status staying unsettled, and the legal and consulting apparatus paid to manage that ambiguity indefinitely rather than resolve it. The lock-in: performative acknowledgment costs nothing and settlement costs someone specific, so acknowledgment is what gets renewed each cycle. Fixing it starts with the questions below.
